Civil Partnership
Same sex relationships
The Civil Partnership Act 2004 came into force on the 5th December 2005.
A Civil Partnership is formed when two people of the same sex sign a partnership document before two witnesses and a registrar. The Registration must take place in England and Wales.
Civil partnerships offer same sex couples many of the rights and obligations that married couples have.
We are able to offer expert advice on a full range of Civil Partnership issues including:
- Entering into a pre registration contract (similar to a pre-marital agreement)
- Terminating civil partnership, including advice on procedure
- Financial settlement procedure
- Types of financial settlement and the approach of the court
- Company or business issues
- Pensions
- Children
Applications
Civil partners and former civil partners will be able to make an application for financial provision for children of the family and amendments have also been made to the Children Act 1989 by the Adoption and Children’s Act 2002. The Act enables a step parent to apply for parental responsibility for a child of his spouse or civil partner other then through a residence order. This can be achieved by agreement or Order of the court.
