What is the Most Important Thing to Do When You Are Getting a Divorce ?

A divorce can be a highly emotional and stressful time in your life. When you and your spouse are divorcing, several concerns and questions are raised, with countless things that need to be resolved. Who will file the divorce application? Where will the children spend their time after separation? Does the house need to be sold, and what shares does each party receive?


These are all valid, important issues; however, for security in the long term, the most important thing to do is have an order approved by the Court that sets out what you have agreed on in the financial matters, which also dismisses your claims against each other.


 

Why is it the most important?


  • An order approved by the Court relieves any fear you may have for your future.


  • There will be no 'second bite of the cherry' for your ex-spouse in the case that your financial position unexpectedly improves. Your ex-spouse will have no claim against you and your finances.


  • The court will review the terms which have been set out for your divorce and by taking into account the circumstances and specific details of the case to ensure a fair outcome has been reached for both parties.


  • A court order is legally binding, this makes it enforceable by law. Divorces can lead to many disagreements however having a court order provides enforceability and can ensure if one party does not comply with agreed terms then the other party is able to seek enforcement. This can include maintenance payments.


 

While you may think that divorces are final once two parties decide to separate, a court order provides you with legal weighting which can protect you in the future and provide you with a fair outcome for each party involved.



Even if you believe that your divorce is straightforward and amicable, it is more than an emotional end to a relationship and with the correct legal support a court order provides you with legal protection, clarity and the structure you deserve.
